1. Definitions
1.1. www.hinda.ee web-portal, with all of the included functionality and databases;
1.2. User - the self-employed Portal visitor;
1.3. Manager-person organizing the portal administration;
1.4. The service provider - a person whose economic and professional goods or services offered on the portal is added to the database;
1.5. A third person, a person who is not a user, or the Managed Service provider;
1.6. Review- The User's Opinion on the portal;
1.7. Terms of Use - Managed by this document, the agreement between the user and the user of the portal.
2. General Data and Principles
2.1. Portal owners and operators are OÜ Hinda (commercial registry code 111442675), e-mail hinda@hinda.ee.
2.2. The portal allows users to exchange information on service providers, on the quality of goods and services.
2.3. The portal users are able to comment on each other's reviews and give points for their usefulness. The greater the usefulness of the review, the greater the impact on the overall rating on the service provider.
2.4. The portal is ideologically, political, religiously, racially, ethnically and culturally independent.
2.5. Use of the full functionality and successful functioning of the portal is possible in the existence of a user account on a user.
2.6. The effective functioning of the portal depends on correct personal data and regular disclosure of certain personal data.
2.7. Use of the portal works on the "as is" principle. Portal manager is not responsible for the consequences arising from potentially harmful use of the portal for the providers and third parties.
3. The user has the right to:
3.1. To create a user account on the portal;
3.2. Write reviews about service providers and their goods and services. It is assumed that the user has personally used the service provider goods or services that he or she is evaluating. The user has the right to share the experience of its acquaintances, provided that the user is ready to take responsibility for the views expressed;
3.3. take part in all the campaigns within the portal;.
3.4. After logging in to the portal give points and add comments to other user’s evaluations;
3.5. to enter a new service provider to the portal;
3.6. use the information published in the portal for personal purposes to make better consumption decisions. To use published information for other purposes you have to ask the manager of the portal electronically at hinda@hinda.ee;
3.7. send a request to eliminate or change potentially false information;
3.8. to make improvement suggestion to the manager of the portal in order to improve it. The manager is grateful for all corrections and take them into account in accordance with its capabilities.
4. You agree to:
4.1. not to use the opportunities offered by the portal, if it does not agree with the Terms of Use;
4.2. Disclose only truthful information in the portal;
4.3. ensure the reliability of your reviews;
4.4. prove and give extra information about your review, if there is a dispute regard a review written by you;
4.5. not publish commercial announcements in the portal, announcements aimed at violence and propaganda;
4.6. to refrain in every way from discriminating other users;
4.7. not to infringe the privacy of other users, and convenient ways to use the portal;
4.8. not to use the opportunities offered by the free portal for business interests, and unfair competition action, including misuse of confidential information, to slander service providers and third parties goods or services, etc.;
4.9. not to enter the portal writings, for what you do not have permission to do as a user;
4.10. not to use for text input, for viewing user accounts or the data contained in the portal computer programs or scripts.
5. The user account creation
5.1. The user has the right to create only one user account.
5.2. The user is required to create a username, which is consistent with the generally accepted moral and good practice.
5.3. On the user account creation and use you are required to provide the correct contact information.
5.4. The user is not allowed to add images to your account, which include commercial communications, the elements of unfair competition, are unprintable or otherwise contravene to the generally accepted moral and good practice.
6. Administrator has the right to:
6.1. to use the data entered by the users and other material only to ensure the smooth cooperation between the users and the portal, the opportunities offered by the portal, and to improve the quality of new development opportunities.
6.2. to change and supplement the portal's functionality, architecture and other elements of the portal;
6.3. to present and send commercial announcements to users;
6.4. demand the fulfillment of the Terms of Use;
6.5. delete assessments, reviews, writings, etc., where the user has failed to fulfill its obligations under the Terms of Use, or which are contrary to the laws in force in the Republic of Estonia;
6.6. to close user accounts without warning when a user has created more than one account on their own, chosen to create an inappropriate user account or if the user violates the Terms of Use consistently;
6.7. to block visits to the portal to a user who consistently violates the Terms of Use.
7. Manager liabilities
7.1. Manager shall ensure the confidentiality of personal data entered into the Portal or any users personal information to third parties, except when there is a corresponding obligation from the legislation in force in the
7.2. Portal administrator will ensure the smooth operation and functioning of the portal.
7.3. Administrator is not required to justify the measures implemented to the user, if the user violates the Terms of Use.
7.4. Manager strictly follows the principle of the independence of the portal and the portal and while administering follows the generally accepted moral standards and good practice.
8. The protection of personal data
8.1. With the creation of the user account, the user gives the administrator the permission to process and publish user’s personal data to other users.
8.2. The public personal data is:
8.2.1. User name and surname,
8.2.2. The user's sex,
8.2.3. The user's date of birth (age),
8.2.4. The user's geographical location,
8.2.5. The user's position and the profession,
8.2.6. The user's interests,
8.2.7. Characterization of user text or image file format, which is displayed at the user.
8.3. All personal data published of the user, can be seen and edited at your account.
8.4. Manager processes personal data in order to enable the user to better evaluate the information published by other users. Administrator also uses personal data to deliver information related to the user’s personal interests, or to provide information on the portal’s innovations and changes.
8.5. The manager does not disclose users' personal information or transmit them to third parties, if the user has not given approval, unless the corresponding obligation proceeds from the current legislation of the
8.6. The user is at any time given time the right to delete your account and to prohibit the processing of personal data concerning him.
9. Protection of intellectual property rights
9.1. The writing, including estimates, comments, images, etc. entered by the user to the portal belongs to their authors'.
9.2. The writings, including estimates, comments, images and similar proprietary rights entered by the user to the portal belong to the manager.
9.3. Administrator has the right to present the users writings (assessments, reviews, images, etc.) outside of the portal to present the portal without asking separate permission.
9.4. If the Manager presents the writing inserted in the portal within the portal or outside of the portal, the manager has the right to choose from of presentation of the writing, but to indicate the author, the manager has the right to use to username, who inserted the writing to the portal.
9.5. Manager is obliged to stop violating the individual rights of the user, who entered the writings to, in a reasonable time after becoming aware of the violation.
9.6. In the event that a user has entered the portal writings, which publishing rights he or she does not possess and thus has created damage to the service provider, manager, or to a third party, the user is responsible for loss or damage arising from the writings entered.
